2.1Scope
2.1.1These terms govern the sale of Kessler products by Novapharm to pharmacies, hospitals, clinics, distributors and other buyers in the Middle East.
2.1.2By sending an order or a quotation request, the buyer accepts these terms. Any different terms apply only if Novapharm agrees to them in writing.
2.2Prices
2.2.1Prices are shown in Jordanian dinars (JOD) per pack and include shipping to Jordan and Palestine.
2.2.2Shipping costs may vary depending on circumstances. Any change is confirmed with the buyer before the order is final.
2.2.3Prices may change without notice until an order is confirmed. The price in the written order confirmation is the price that applies.
2.2.4Orders above €20,000 and tender requests are priced by individual quotation.
2.3Orders
2.3.1Products are sold in full cartons. The number of packs in each carton is shown with each product.
2.3.2An order sent through this website is a request to buy. It becomes binding only when Novapharm confirms it in writing by WhatsApp or email.
2.3.3Novapharm may decline or partly accept an order, for example when stock is limited.
2.4Payment
2.4.1Payment terms are discussed and agreed when the order is placed. They depend on whether the purchase is a one-time order or made under a supply contract with Novapharm.
2.4.2For clients with a supply contract, the payment terms in that contract apply. For one-time orders, the terms stated in the order confirmation apply.
2.5Delivery
2.5.1Delivery is normally within 5 to 7 weeks from order confirmation. Delivery times are estimates, not guarantees.
2.5.2Novapharm will inform the buyer of any expected delay as soon as it becomes known.
2.6Inspection and claims
2.6.1The buyer should check each delivery on arrival. Damaged packaging, missing cartons or wrong products must be reported within 24 hours of delivery, with photos where possible.
2.7Returns
2.7.1For hygiene and patient safety, sterile and medical products cannot be returned once delivered, unless they are defective, damaged in transit or not what was ordered.
2.7.2Returned or claimed products are inspected by Novapharm before any replacement or credit is given. Accepted claims are settled by replacement or credit, at Novapharm's choice.
2.8Warranty
2.8.1Products carry the manufacturer's warranty. Kessler blood pressure monitors carry a 5-year warranty.
2.8.2The warranty covers manufacturing defects. It does not cover misuse, accidents, unauthorised repairs or normal wear, such as batteries and cuffs.
2.8.3Proof of purchase is needed for any warranty request.
2.9Liability
2.9.1To the extent permitted by law, Novapharm's liability for any order is limited to the price paid for the products concerned.
2.9.2Novapharm is not liable for indirect loss, such as loss of profit or business.
2.10Events beyond our control
2.10.1Novapharm is not responsible for delays or failures caused by events beyond its reasonable control, including border closures, shipping disruption, strikes, natural disasters or government action.
2.11Governing law
2.11.1These terms are governed by the laws of the Hashemite Kingdom of Jordan. Disputes are referred to the competent courts of Amman, unless agreed otherwise in writing.
